TERMS AND CONDITIONS – NICKELODEON JIG-SAW PUZZLE CONTEST (“CONTEST”)
This Contest is organized by Viacom 18 Media Pvt. Ltd. ("Organizers") and is open to all the registered users of “Nick” India (www.nickindia.com) website (“Website”) and who are residents of India. In case of participation by any persons under the age of 18 years (minors), participation in this Contest by any Participant shall be with the prior consent of the parent/guardians and will be deemed as participation with the prior consent and knowledge of the Participant’s parents. Directors, officers and employees of Viacom18 or any of their respective affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, sponsors of the Contest viz. Explore, associate vendors and immediate families of each are not eligible to enter the Contest. All applicable federal, state and local laws and regulations apply. Offer/Contest void where prohibited.
To participate in the Contest, a participant needs to log-on to the Website and register themselves before participating in the Contest. The participants will be shown a picture of “The Battle Tank” Toy at the beginning of the Contest. Once the participant clicks on the ‘START’ button, the Battle Tank image will be fragmented into smaller pieces, all jumbled up (“Jigsaw Puzzle”). The participants will need to rearrange the Jigsaw Puzzle and form the Battle Tank as it was shown in the image at the beginning of the Contest. The time taken by each participant to complete the Jigsaw Puzzle will automatically be recorded by the Website and the participants who complete the Jigsaw Puzzle in a correct manner as displayed in the image shown at the beginning of the Contest, in the minimum span of time, shall be chosen as winner of the Contest at the end of the Contest Period.
The Contest commences on 06th December 2012 and closes on 22nd December 2012 or on a date as decided by the Organizers (“Contest Period”).
During the Contest Period, ten (10) participants who have correctly solved the Jigsaw Puzzle in the minimum span of time shall be selected as the final winners (“Winner(s)”) and entitled to the Prize (as set out herein below). The Participants or any third party shall have no right to question the process of selection. Each of the ten (10) Winners so selected by the Organisers shall be entitled to a prize of “Gift Set” (Iken branded).
No charges shall be applicable for logging onto the website www.nickindia.com except any internet charges/data charges spent by the Participant in accessing the Website. All other incidental costs including travel and boarding, if any, that may arise from participating in the Contest will be borne by the Participant. The Organizers shall not be responsible in case of any network problem such as breakdown of machinery, poor network availability, disruption in the network, inconvenience/ hindrance caused, and/ or the cost of the internet usage charged by the Service Provider or otherwise. Any dispute in connection to the same shall be settled between the Participant and the Service Provider without involving Organizers.
Income tax, gift tax or any other statutory taxes, duties or levies (if any) as may be applicable from time to time, arising out of free Prize/s, shall be payable by the Winner/s of the respective prize/s. In case the Winner fails to comply with the applicable law/s, the Organizers will be entitled to select another winner at their own discretion.
The Prize(s) shall not be transferable/ redeemable for cash. No request shall be entertained by the Organizers in this behalf.
The Organizers shall not be responsible for the quality or deficiency etc. of the Prize/s and no claim or request, whatsoever, in this respect shall be entertained by the Organizers.
The Organizers reserve the right to change/ modify terms and conditions and/ or criteria of the Contest and / or the Prize for the Contest and/ or the duration/ timing of the Contest, at any time at their own discretion and without any prior notice and without assigning any reason.
The decision of the Organizers in connection with the Contest will be final & binding and is non-contestable.
The Winners will be notified by post, email and/or by telephone. To claim a Prize, Winners should follow the instructions contained in their notification. The Organisers accept no responsibility for any variation in the value of any Prize (or any part of it). The Organisers reserve the right to substitute any Prize (or any part of it) for an item of similar value. The Organizers shall not entertain any questions, correspondence, enquiries on the manner of conduct of the Contest and grant of the Prize/s from any party whatsoever.
Apart from the entitlement to the Prize, the Winner or his/her legal heirs will have no other rights or claims against the Organizers. Organizers do not provide any warranty or guarantee the proper functioning of the products which comprise of the Prize and/or any warranties with respect to the Products or any defect in the products shall be directly taken up with the producers of the said products.
The Participant acknowledge that he/she will not hold the Organizers and/ or any of its affiliates or agencies engaged by them with regard to this Contest liable for any loss or opportunity, monetary loss due to their participation in the Contest.
The Organizer is not responsible for any errors or omissions in the terms and conditions contained herein. All information provided in the Contest is provided "As is" without warranty of any kind. The Organizer makes no representations and disclaims all express, implied and statutory warranties of any kind to the Viewer and/or any third party including, without limitation, warranties as to accuracy, timeliness, completeness, merchantability, or fitness for any particular purpose.
Under no circumstance, unless due to willful misconduct or gross negligence, shall the Organizer and/or their directors, employees, officers, affiliates or subsidiaries, be liable to the Participant and/or any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever, even if the Organizer has been advised of the possibility of such damages. The Participant specifically agrees not to file in person/through any family member and/or any third party any applications, criminal and/or civil proceedings in any courts or forum in India against the Organizer and/or their directors, employees, officers, affiliates or subsidiaries to claim any damages or relief in connection with the Contest.
The Participants grant the Organizers irrevocable consent in perpetuity to the use his/ her name, photographs, video tape taken during the prize distribution in connection with the Contest, in any and all applications including but not limited to advertising, commercials, promotion, stories, text, articles and commercial exploitation, in any and all media forms, including but not limited to radio, broadcast and television, newspapers and magazines at any time without the Participants further knowledge or consent.
In case of any dispute or difference in respect of this Contest, the decision of the Organizers shall be final and binding on all concerned.
Participation in this Contest implies acceptance of all the terms and conditions of the Contest. Acceptance of the Prize/s by the winner constitutes permission for Organizers, and its affiliates to shoot videos, click photographs of the Winner/s and use the Winner's name, photographs, likeness, voice and comments for advertising and promotional purposes in any media worldwide for purposes of advertising and trade without any additional compensation whatsoever. It is the Participants’ responsibility to ensure that their personal details (name, address, date of birth, email id, ID Proof) are always updated and accurate in order to be able to receive the gratification/ notification in time.
In order to avail the Prize the Winner must collect the same from the office of the Organizers upon presentation of appropriate and credible ID proof and sign a release form as may be required by the Organizers. Any winners under the age of 18 years (Minors) would need to present written consent from the parent/guardian to claim the Prize. The Organizers may in their sole discretion courier the Prize to the Winners if they so deem fit on the cost and expense of the Winner.
In the event Winners announced do not collect the Prizes within 7 days from the date of the announcement, the Organizers may forfeit the Prize or select another Winner.
In case of any dispute or difference in respect of this Contest, the decision of the Organizers shall be final and binding on all concerned.
The Contest and these Terms & Conditions will be governed, construed and interpreted under the laws of India. Entrants agree to be bound by these Terms & Conditions and by the decisions of the Organisers, which are final and binding in all respects. The Organisers reserves the right to change these Terms & Conditions at any time, in its sole discretion, and to suspend or cancel the Contest or any entrant's participation in the Contest should viruses, bugs, unauthorized human intervention or other causes beyond the Organiser’s control affect the administration, security or proper play of the Contest or the Organiser otherwise becomes (as determined in its sole discretion) incapable of running the Contest as planned. Entrants who violate these Terms & Conditions, tamper with the operation of the Contest or engage in any conduct that is detrimental or unfair to the Organiser, the Contest or any other entrant (in each case as determined in Organiser's sole discretion) are subject to disqualification from entry into the Contest. The Organiser reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Contest.
These Terms & Conditions (and any dispute, difference, proceedings or claim of whatever nature arising out of or in connection with these Terms & Conditions) shall be governed by, and construed in accordance with, the laws of India and shall be subject the exclusive jurisdiction of the Bombay High Court.
