The following are the terms and conditions (the “Terms and Conditions”) for “SHOP & WIN Contest” (hereinafter referred to as “Contest(s)”), which will conducted by TV18 Home Shopping Network Limited (“HomeShop18”) on its website www.homeshop18.com (the “Website”). By participating in the Contest and/or performing any act/s as required in relation thereto, you (the “Contestant”) unconditionally accept and agree to comply with and abide by these Terms and Conditions as stated herein or as may be modified at any time by HomeShop18.
The participation of the Contestant in the Contest shall mean that the Contestant has read, understood, accepted and agrees to abide with all the Terms and Conditions contained herein and represents that he/she is eligible to participate in the Contest. If a Contestant does not agree with any of the terms and conditions, then the Contestant should not participate in the Contest.
1) This Contest will commence on 12th August 2014 and will expire on 31st August 2014 (“Contest Period”).
2) This Contest is not open for employees and/or family members of employees of HomeShop18 or any other Network18 Media & Investments Limited subsidiaries or group companies and those of the One97 Communications Limited (Paytm) and any of their subsidiaries or group companies.
3) This Contest is open only to Indian citizens who are residing in India during this Contest Period and are above the age of eighteen (18) years. Persons who are not "competent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents, etc., are not eligible to participate in the Contest.
4) The names of the Contestants who have won the Contest (“Winner(s)”) will be announced on http://www.shoppingmakesmehappy.com/contest on 10th September 2014.
5) The prizes to be given to respective Winners shall comprise of co-sponsored prizes by HomeShop18 & Paytm (Sponsors). Rs. 100 Cash back in Paytm cash wallet with minimum purchase of Rs. 500 & above made at www.homeshop18.com using Paytm wallet as paymode, 3 VU LED TV (“TVs”), 5 Android phones, 10 JBL speakers, 50 Gift Vouchers worth Rs. 1000 each (The TVs, phones, speakers, Gift vouchers are hereinafter collectively referred to as “Prize(s)”).
6) It is clarified that any and all responsibility in respect of the Gifts shall rest with the respective manufacturing/servicing brand alone and HomeShop18 has no role or liability in the same. HomeShop18 makes no representations or warranties of any kind, express or implied and shall have no responsibility with regard to their condition, their fitness for a particular purpose, etc. HomeShop18 accepts no responsibility for any variation in the Prize shown.
7) In the event that any of the Winners selected by HomeShop18 is unwilling or unable to give his/her acceptance to the Terms and Conditions of the Contest within 3 days of intimation of the same, then HomeShop18 shall select another eligible Contestant as the Winner who gives his/her acceptance to the Terms and Conditions of the Contest.
8) To be eligible for the Contest, a Contestant must do the following:-
a) They must shop worth minimum Rs. 500 at www.homeshop18.com using Paytm wallet as pay mode within the Contest Period.
9) The Winners will be required to comply with the following pre-requisites prior to being handed over the Prize:
a) Furnish his/her name, address, age, sex, contact number;
b) Provide a copy of his/her photo identity card, valid PAN card;
c) Provide a valid proof of address;
d) Provide a proof of the ownership of the mobile number.
10) The Winners will be randomly selected by HomeShop18 from the list of eligible Contestants. Any cancellation of an order placed by the Contestant will lead to disqualification of the Contestant and he/she shall not be entitled to any Prize. If a person purchases products, before or after the relevant promotion period or in contravention of the provisions of these Terms and Conditions, then he/she will not be able to participate in the Contest. In the event a person who is not "competent to contract" within the meaning of the Indian Contract Act, 1872, participates and wins this Contest; he/she shall be disqualified forthwith and shall not be entitled to any Prize.
11) All applicable taxes, duties or levies as may be applicable from time to time, arising out of Prize, shall be payable by the Winner of the respective Prize. Any and all incidental costs direct/indirect, in relation to the participation in the Contest/collection of Prize, if any, shall also be borne by the respective Contestant/Winner. HomeShop18 shall not be responsible or liable for the same in any manner whatsoever.
12) The Prize will be dispatched to the Winners within a period of 30 days from the date of delivery of the product purchased by them.
13) The Prizes cannot be exchanged for cash or cheque or any other benefits. The Winners will not be entitled to any compensation/benefits in any form whatsoever in lieu of the Prize. Further, no requests will be entertained for the exchange of one Prize for another Prize.
14) HomeShop18 shall not be responsible and/or liable in any manner whatsoever for any network problem, breakdown of machinery, disruption in the network and/or the cost of the internet session charged by the Internet Service Provider etc.
15) HomeShop18 shall not be liable for any loss or damage whatsoever that maybe suffered as a result of participating in this Contest or using any Prize.
16) The Contestants, who have not won the Contest, will not be eligible for any Prize or any other gratification for participating in the Contest.
17) HomeShop18 reserves the right to disqualify a Contestant/Winner in the event HomeShop18 observes any irregularity in the purchases made by the Contestant/Winner and/or if HomeShop18 in its knowledge has reason to believe that the Winner has acted in a fraudulent manner and/or has violated these Terms and Conditions.
18) All rights (including intellectual property rights), title, claim and interest in the promotional material(s) and any/all entries received shall vest solely and exclusively with HomeShop18 at all times.
19) HomeShop18 does not warrant that the Website will run concurrently and error-free during or after the Contest Period and does not commit any uptime of the Website. HomeShop18 does not warrant that its call center will run concurrently and error free during and/or after the Contest Period. Further, HomeShop18 shall not be liable for issues related to technical or human error whatsoever.
20) If at any time during the continuance of this Contest, the performance in whole or in part is prevented or delayed by reasons of a Force Majeure event, then there shall not be any claim against HomeShop18 for damages or any liability, in respect of such non-performance or delayed performance. For the purposes of this Contest, Force Majeure event means and includes any event beyond the reasonable control of HomeShop18 including war, hostility, fires, floods, explosives, epidemics, quarantine restrictions, strikes, lock outs, compliance with orders or instructions of any court, statutory or governmental interventions or any other Act of God.
21) HomeShop18 reserves the right to change, modify, alter, postpone or cancel this Contest in part or in full or change any or all of the Terms and Conditions and/or eligibility criteria of this Contest at any time at its own discretion and without any prior notice/intimation and without assigning any reason. HomeShop18 shall not be liable for any consequential losses/damages arising out of such change, modifications, alteration, postponement or cancelation of this Contest.
22) All decisions of HomeShop18 regarding running/process/results, of the Contest, data selection shall be final and binding on all participants of this Contest. No appeals will be entertained in this regard. No correspondence disputing this Contest, Terms and Conditions, decision relating to the Winners, any decision of HomeShop18’s management, etc., will be entertained by HomeShop18. By entering into the Contest, it shall be deemed that the Contestant has waived his/her right to dispute any decision(s) made by HomeShop18.
23) This Contest shall be governed by and construed in accordance with the applicable laws in India. All matters with respect to this Contest are subject to the jurisdiction of the Courts at New Delhi only.
